Two months after surviving a tragic plane crash, Travis Barker is suing Bombardier Inc., Clay Lacy Aviation and Goodyear Tire and Rubber, alleging the Learjet was defective, TMZ.com reported on Friday.

The suit, filed in L.A. County Superior Court, was filed by Barker and Thelma Martin Still, the mother of Charles "Che" Still, Barker's bodyguard who died in the crash on September 19.

The suit alleges "one or more of the tires failed leaving tire debris and portions of airplane components along the 8,600 foot runway," as well as, "a negligent attempt to abort takeoff."

Barker and Martin also claim, "It's landing gear, tires, wheels, brakes, reverse thrust system, squat switches and component parts were not airworthy."

Barker, who suffered second and third degree burns on his hands and lower body is suing for "pain and suffering, mental anguish, psychological and emotional distress and disfigurement and pre-impact fear of death and burning," according to TMZ.

Barker suffered second and third degree burns on his hands and lower body, but but recently revealed he is doing much better.

"Thanks for all the support. I feel better every day," he said on Sunday's TRL finale in his first televised interview since the accident. "I'm already playing my drums again, and I'm already back in the studio."

    Current money doesn't matter. In fact, a celeb who is disfigured has a great deal more to sue for than someone whose looks don't matter. The grounds for a lawsuit are about what you lost, not what you have. Sheesh! Even wrongful death suits are about financial impact. "Justice" is for the criminal court to decide like is the company guilty of manslaughter.

    In other words people who die and are unknown unlike Travis are the only ones who should be able to sue somebody ? Give it a rest we are all created equal at birth, it's what you do with your life that makes you special Some people have special gifts and those who don't are simply jealous.

    Ummm, all things considered....any one of you "haters" would sue them too. BTW, the other families are involved. Travis has every right to sue. Who do you think is paying for his medical care and lost wages? He isn't suing for some grand amount of cash either, which some of you would be doing if this had been you instead.

    I see some of you guys saying that the Travis should be showing some respect to the families and that the families are the ones that should be suing Thelma Martin who is also suing and is mentioned in the article, is the mother of one of the deceased. Just because he's suing does not mean he's not being respectful to the deceased. He has every right to sue.

    He feels like he is entitled. He does NOT deserve any money. Sure he got injured, but others died. It should be those families that get the money not his rich ass. What is to say it is not his fault? He did insist upon leaving late at night. Maybe he rushed the pilot and they did not check everything thoroughly.

    I'm glad they're suing. Maybe it'll force companies to seriously check their planes, trains, cars ect. I mean think how often you take your car to get checked. Now think how often you would have it done if you were driving hundreds of thousands of miles a day like a plane. And yet most of these companies only check their equipment out once a year, if that. Go Travis!!!
