"The divorce documents were filed Jan. 5, 2008, by Patricia Arquette," the officer told Us. She is seeking separate property.
The couple, who had been engaged since 2002, tied the knot in Venice, Italy, in June 2006.
They have a five-year-old daughter, Harlow.

Arquette, 40, previously wed Nicolas Cage in 1995, but they separated after only nine months.
Thomas, 39, who starred in 2004 flick The Punisher, was previously married to actress Aysha Hauer.
