Levi Johnston - the 19-year-old father of Bristol Palin's baby - may pursue legal action for custody of their 4-month-old son, Tripp.

On Wednesday's Larry King Live, Levi and his family - who claim the Palin family won't let Levi be alone with his son - said they have hired a lawyer.

Asked if they'll go to court, his mother, Sherry, said, "We were just hoping that we wouldn't have to.You know, we really didn't have to want to go this way. I was hoping that we could all come to an agreement and all, you know, get together and be there for Tripp."

Levi told King that he and Bristol, 18, do not have a formal child custody agreement.

"No, we don't have anything like that," he said."We haven't went to court or done anything at all."

His sister Mercede said she hopes they come up with one soon. "I want that baby in my life just as much as he does," she said.

Added Sherry, "We want to keep this on the lowdown and have, you know, not start trouble. But, obviously, if things don't change, that's our next action when we get back is to go forward with that, I guess."

Levi clarifies that he can go to the Palin's home and see his boy, but "it's kind of an uncomfortable thing ... You know, I want to be able to take him and do that kind of thing, go do the father thing with him and I can't."

Levi said he wasn't sure what happened to cause a fall-out with the Palin family.

"I think somewhere along the lines, we just, you know, weren't hitting it off anymore and..." he said.

Although he has said before that Alaska Gov. Sarah Palin probably knew he and Bristol were sexually active, he declined to say whether they had sex under her roof.

"You know, Larry, that I'm a gentleman, you know," he said."And I don't, you know, kiss and tell. So, you know, I don't think that really -- that really matters. I mean..."

Levi - who has previously bashed the Palin family on The Tyra Banks Show and CBS' Early Show - also denied that he is speaking out now in a quest for fame.

"I didn't ask to be thrown into this, so I'm not out here looking for fame," he said. "I'm just trying to get my story out there, let the people know what's really going on.So, you know, I'm not looking to get famous, be a celebrity. That's not what I'm doing."

Last comment by me: if Bristol is being a spokesperson and getting her degree, that's all the more reason for the dad to step in and spend more time with the child -- not the grandparents, not nannies, not other relatives and sitters. Parents first. Both of them. Let them have joint custody.

Levi should be allowed to do the father thing. The kid needs a father, especially if he has one.

Bristol did not make that baby by herself. They went half on the child. So she doesn't have the right to lord over this child anymore than the father does. She could lose custody for being a hostile mother and teaching the child to be hostile toward his father. There are great lawyers who would would take this case pro bono for Levi to show the Palins they aren't so privileged a
