According to TMZ.com, Fey filed for divorce Monday, citing irreconcilable differences.
The couple, who have been separated since January, have two children, Xavier, 15, and Elijah, 6.
In addition to seeking sole custody of their kids, she has also requested spousal support.

Fey and Wahlberg, 39, met when she did session work for Donnie's brother's group, Marky Mark and the Funky Bunch.
Wahlberg and his band, New Kids on the Block, reunited in May after 15 years.
He recently celebrated his 39th birthday at Jet nightclub in Las Vegas with his fellow NKOTB members Joey McIntyre and Danny Wood.
Their newest tune, "Single," was released Aug. 12 on iTunes.
