Birkhead Granted Guardianship After Probate Hearing

LOS ANGELES, Calif. (June 19, 2007) Months after a Bahamas court declared Larry Birkhead the biological father of Anna Nicoles only daughter, a US court has granted him guardianship of the little girl for probate hearings over Smiths will.

Smiths will was admitted to probate this morning by an LA Superior Court judge. Smiths longtime companion Howard K. Stern was named the wills executor.

As previously reported on AccessHollywood.com, Smiths will provided for just one child, her late son Daniel. Smiths will was written before Daniels death and before she became pregnant and gave birth to daughter Dannielynn.

Bruce Ross, attorney forStern filed papers this morning claiming there was no intention by Smith to disinherit unborn children despite wording in the original will wording. It is believed Ross filed papers to address Article One of Smiths last will and testament, which stated Except as otherwise provided in this Will, I have intentionally omitted to provide for my spouse and other heirs, including future spouses and children and other descendants now living and those hereafter born or adopted, as well as existing and future stepchildren and foster children.

This could be the first step in a long chain which could eventually lead to Dannielynn Hope Marshall Birkhead inheriting millions of dollars in the estate of the late J. Howard Marshall.

Birkhead and Howard K. Stern both appeared in the courthouse this morning.

Smiths mother Virgie Arthur will receive a copy of the court determination.

you know what i think that they should just stop everything i mean if they already decided that the baby belongs to larry then thats it case closed there shouldnt be anything else to talk about

I think that larry got the kid and everbody should just leave him the hell alone they arent going to get her and its not like the kid is being treated bad she has a good father and a good home.i think they just want him for his money.

I recently saw an article that Virgie Arthur has private eyes investigating Larry trying to dicredit him so she can get custody of the baby. She is all about the money if she really cared about her grandchild she could have petitioned the courts for custody of Daniel when she knew Anna was so involved with drugs. Leave Larry alone Virgie let him raise his daughter in peace he's a good DADDY!!!!!

Iam glad the baby is with her real father, but who can judge and say how Howard would care for her. He loved her and still does. He did what Anna wanted, and when someone is on drugs, you can talk and talk, but they do what they want. I know. I went through it with my son. I thank God, he got help and is now drug free.

I think it is wonderful that Larry got his daughter. I think it is wonderful that we get to see pictures of the baby. She is a cutie and looks just like her dad. People seem to forget too that he started the request for paternity since Dannielynn was first born. He should get a medal for taking a stand and proclaiming he was the father. How many dead beat dads are there in this world? Kay

Larry needs to bring that baby back to Louisville, KY and raise her where she will not constantly in the spotlight and let her grow up the way children should. He can keep the public updated on her progress, but let her be a happy child, children always in the spotlight; look at Paris & Nicole. Anyway she is a CUTIE!!!

Glad to see the baby go to her bio daddy. I agree, Howard Stern is a druggie/pusher/enabler and doesn't deserve to raise the baby. Did anybody see his interview on the plane back to the Bahamas where he looked so "high" he could have fueled the plane with his brain? lol I think he actually was the supplier of the drugs for both Anna Nicole and her son. Maybe he tried to get rid of them both4$$$
