Adrienne Maloof and Paul Nassif divorce takes nasty turn as she accuses him of child abuse, gets restraining order

So much for that “positive attitude” Adrienne Maloof was hoping she and husband Paul Nassif would both maintain during their divorce. In the seven weeks since the “Real Housewives of Beverly Hills” couple announced their separation on July 30, the two have been at war, accusing each other of everything from gun violence to alcohol abuse, and now, child abuse.

On Wednesday, Maloof’s lawyer appeared before a judge and claimed that the famed Beverly Hills plastic surgeon had choked one of his three sons (Gavin, 9, and 6-year-old twins Colin and Christian) who was fighting with his brothers during a car ride home from school last Thursday. In addition, Maloof alleges that Nassif, 50, took the punishment too far with one son when he “threw him in the corner” after he misbehaved during bath time (the boy later told a psychiatrist what happened, according to TMZ). The couple’s chef also filed a declaration to the judge claiming he had witnessed Nassif kick the family dog after it had an accident in their home.

After hearing all the evidence against Nassif – who was not told ahead of time that his ex was going to court and, therefore, he did not have his attorney present – the judge granted Maloof temporary custody of the three children. The reality star, 51, was also granted a temporary restraining order against Nassif for her and the kids, keeping him at least 100 yards away from them. A court date is set for October 9 to determine if both orders will become permanent.

“This smacks of underhandedness,” says Nassif’s attorney Lisa Meyer. “Adrienne wasn't even present when this allegedly occurred. It is a sad day when parents have to stoop to the level of making false allegations against another parent."

Maloof and Nassif aren’t just ending their 10-year marriage. They are also parting ways with the sprawling 20,000 square-foot French chateau-style mansion that has been featured prominently on the Bravo series for the past two seasons. The eight-bedroom, 11-bathroom home is now on the market for $26 million – $13 million more than what they paid for it back in 2004.
