On Tuesday, the former “Real Housewives of Atlanta” star was slapped with a lawsuit by castmate Kandi Burruss over royalties she claims were never paid to her for writing Zolciak’s 2009 hit single, “Tardy for the Party.”
According to court documents – in which Zolciak’s first name is spelled wrong! – the song has sold 102,000 copies/downloads and Burruss, along with fellow plaintiff and co-songwriter Rodney Richard, want the mother of four to provide all “substantial profits and ill-gotten gain,” a part of which they believe they are owed.
Oh, and who is Burruss’ attorney? None other than her “Real Housewives” co-star Phaedra Parks.
The day after the filing, all of the ladies were forced to be in the same room for the taping of the Season 5 reunion special … perfect timing for host Andy Cohen to bring up the subject, no? Still, royalties over “Tardy for the Party” is old news. It was brought up during the Season 3 reunion special, during which Burruss tearfully explained that the song earned Zolciak “$80,00- to $100,000 at least,” but she only received $3,000 or $4,000. Still, she said, “I don’t like to argue about money with friends.”
But that has all seemingly changed now.
On Monday, Burruss expressed her worry over the impending face-to-face with Zolciak. “Well, we're shooting the #RHOA reunion on weds,” she tweeted. “Im NOT looking 4ward 2 it. I can already c its gonna b DRAMA. Arguing makes my stomach turn.”
So then why not wait until Thursday to file?
Zolciak – who used “Tardy for the Party” for the name of her 2012 TV special, “Don’t Be Tardy for the Wedding” as well as her upcoming “Don’t Be Tardy” (which premieres on Bravo on April 16) – addressed the situation over Twitter on Wednesday after taping the reunion show. “Kandi tried to pull the song down in Dec on iTunes but after I showed documents and proved points song was immediately put back up.”

Before that, she also tweeted, “If I owed her money why did she do another song!” in reference to “The Ring Didn’t Mean a Thing,” the Burruss-penned song Zolciak released in 2010.
“Tardy for the Party” isn’t the only thing Burruss claims Zolciak stole. This season on “Real Housewives,” she also charged that her former friend ripped off something much more important: her baby name idea, Kash, which Zolciak gave to her second son with hubby Kroy Biermann, who was born last August.
